PACE refers to PACE OD Consulting Pte Ltd

Real 4Sights refers to the trademark of Real 4Sights Web Application

Platform refers to the Real 4Sights Web Application which includes the Real 4Sights websites, services and applications

User refers to the person using the services on the Platform

PACE operates an online platform ‘Real 4Sights’ to provide profiling services for Users. 

Use of Content

All contents on this Platform, including but to limited to text, articles, images, software, photographs, graphics, illustrations, artwork, video, audio, names, logos, trademarks, service marks, and other material (collectively, the ‘Content’), are protected by copyright, trademark, and other laws in Singapore and elsewhere. The Contents include both contents owned or controlled by PACE and contents owned and controlled by third parties and licensed to PACE and Real 4Sights. Unless as explicitly indicated on the Platform, you may not sell or modify the Contents or reproduce, display, publicly perform, distribute, or otherwise use the Contents in any way for any public or commercial purpose without the written permission of PACE and Real 4Sights.

If you violate any of these Terms, your permission to use the Contents automatically terminates and you must immediately destroy any copies you have made of the Content.

Some contents on or available through this Platform may have additional restrictions upon its use and all such restrictions form a part of this Agreement.

Cancellations and Refunds

As a general rule, any discounts are non-refundable and non-exchangeable. 

A request for a refund will only be considered if it is made within 30 days from the date of purchase and there was no assessment activated yet.

No Warranties 

The Platform and Contents are provided on an “as is” basis. PACE, Real 4Sights, the Platform, its Licensors, licensees, and its suppliers, to the fullest extent permitted by law, disclaim all warranties, either express or implied, statutory or otherwise, including but not limited to warranties of title, fitness for a particular purpose, merchantability, and non-infringement of proprietary or third party rights. 

PACE, Real 4Sights, the Platform, its licensors, licensees, and its suppliers make no warranties or representations about the accuracy, reliability, completeness, currentness, or timeliness of the Content or other communications provided on or through the use of the Platform.

PACE, Real 4Sights and the Platform do not warrant that the Platform will operate error-free or that the Platform or its servers are free of computer viruses or other harmful items. If your use of the Platform or the Contents results in the need for servicing or replacing equipment or data, PACE and Real 4Sights is not responsible and shall not be liable for those costs.

Some of the contents on the Platform are provided by third parties and PACE and Real 4Sights shall not be held responsible for the contents provided by any such third party.

No Liability / Disclaimer of Damages

Your use of the Platform is at your own discretion. If you are dissatisfied with any of the Contents or other materials on the Platform or with this Agreement, or other PACE terms and policies, your sole remedy is to discontinue the use of the Platform. 

In no event shall PACE, Real 4Sights, the Platform, its respective directors, employees, affiliates, or contents or service providers be liable for any indirect, special, incidental, consequential, exemplary or punitive damages arising from or directly or indirectly related to the use of, or the inability to use, the Platform or its contents, materials and function related thereto, including, without limitation, loss of revenue, or anticipated profits, or loss business, data or sales, or cost of substitute services, even if PACE, Real 4Sights and the Platform or its representative or such individual have been advised of the possibility of such damages.

Indemnity

You agree to defend, indemnify, and hold harmless PACE, Real 4Sights, its respective directors, employees, affiliates, or contents or service providers, from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Content or your breach of the terms of this Agreement. 

To the extent that you may be located through information which you may provide to PACE or Real 4Sights, PACE and Real 4Sights shall provide notice to you promptly of any such claim, suit, or proceeding.

Other Related Products and Services

The Platform provides access to related products and services offered by PACE. Users may purchase the respective products or services by clicking the link(s) to the respective App(s) or Websites.

Privacy Policy

Information of the User shall be strictly and confidentially kept within the Platform. At no time will the information of the User be shared outside the Platform nor will it be shared without the written permission of the User. The Platform takes great pride to ensure that the privacy of Users is maintained at all times.

Term and Termination

PACE, Real 4Sights and the Platform reserve the right, in our sole discretion, to terminate your access to all or part of the Services, with or without notice.

Upon termination, all rights granted to you in these Terms of Use will immediately cease.

To the extent that you have a subscription that extends beyond termination of these Terms of Use unless such termination is due to your breach, the subscription shall remain in force for the period set forth in the subscription’s terms or subscription order. Any provision of the Terms of Use that expressly or by implication is intended to continue in force after termination or expiration of these Terms of Use will survive.

Amendments

These Terms of Use are subject to modifications with prior notice. PACE, Real 4Sights, and the Platform reserve the right to modify or change these Terms of Use and other PACE policies at any time by posting modified documents on the Platform and notifying you of the same for your perusal. You shall be responsible to update yourself of such changes, if any, by accessing the same. You shall, at all times, be responsible for regularly reviewing the Terms of Use of the Platform and other PACE policies and note the changes made on the Platform. Your continued usage of the Platform after any posted changes constitutes your acceptance of the amended Terms of Use and other PACE policies. As long as you comply with these Terms of Use, PACE, Real 4Sights and the Platform grant you a personal, non-exclusive, non-transferable, limited privilege to access, enter, and use of the Platform. By accepting these Terms of Use, you also accept and agree to be bound by the other terms and conditions stipulated herein (including but not limited to Cancellation & Refund Policy) and PACE policies as may be posted on the Platform from time to time.
